MetroKitchen 10 Year Anniversary CIA Sweepstakes Terms and Conditions

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: SWEEPSTAKES ENTRANTS AND PRIZE RECIPIENTS MUST BE LEGAL RESIDENTS OF ONE OF THE 50 UNITED STATES OR DISTRICT OF COLUMBIA AND AT LEAST 21 YEARS OLD AT TIME OF ENTRY TO BE ELIGIBLE. VOID OUTSIDE THE 50 UNITED STATES/DISTRICT OF COLUMBIA AND WHERE OTHERWISE PROHIBITED. Employees and Suppliers of MetroKitchen, Rouxbe.com, Robinson Knife, the Culinary Institute of America and immediate family members (spouses, partners, parents, siblings and children) and all household members of employees of these firms are not eligible. Sweepstakes subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsors’ decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Sweepstakes consists of a sweepstakes (the “Sweepstakes”).
2. Timing: This Sweepstakes begins on 12:01 a.m., Eastern Standard Time ("EST") on November 14, 2008 and ends at 11:50:50 PM EST on January 15, 2009 by when all entries must be received. Sponsors’ computer is the official time keeping device for this Sweepstakes Period. Winner will be notified on or before, February 15, 2009 wtih results of the Sweepstakes.
3. Here’s How to Enter: During the Sweepstakes Period, to enter, go to CIA Sweepstakes, fill in required information on the official entry form, and submit the form as directed. Entrants will be required to provide complete name, home address, telephone number, date of birth, and e-mail address. Entries can also be mailed to “MetroKitchen.com/CIA Boot camp, 4041A Kingston court, Marietta, GA 30067) Limit one entry per person, per household and e-mail address. Multiple or duplicate entries will be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration or entry, the authorized account holder of the email address used to register will be deemed to be the registrant or entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
4. GRAND PRIZE: ONE (1)Grand Prize is the Culinary Boot Camp - Basic Training at the Culinary Institute of America in Hyde Park, NY for five (5) days and $1,000 for travel, lodging and miscellaneous expenses. Retail Value of $3095.00 (USD$). Winner must be available to travel during the time the CIA boot camp is scheduled. Winner must be physically able to attend the boot camp and be able to converse in English. Winner will be notified of Sweepstakes results on or before February 15, 2009. Meals that are NOT part of the prize package, ground transportation, in-room charges (e.g., mini-bar, movies), telephone calls, gratuities, incidentals, upgrades, and any other expenses not specified above are NOT included in the Prize. Potential Grand Prize Winner must be at least 21 years of age at the time of travel. Sponsors shall not be responsible for any cancellations, delays, diversions or substitutions or any acts or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sponsors shall not be liable for any loss or damage to baggage or personal items. Potential Winner must be physically able to travel and attend boot camp at the Culinary Institute of America in Hyde Park, NY for five (5) days and be available to travel and attend on the dates specified by the sponsors, or an alternate winner may be selected. If any potential Prize Winner becomes disabled or cannot otherwise fully enjoy the prize package due to illness, Sponsors shall have the option at their sole discretion of (1) being relieved of liability for fulfillment of the prize award; or (2) extending the period during which such prize may be awarded, depending on the schedule of the Culinary Institute of America. Potential Prize Winner may be required to prove such disability by a doctor’s certificate at Winner’s expense, which certificate may be required to be endorsed by another physician agreeable to Sponsors at Sponsors expense. Prize elements subject to availability, certain restrictions and blackout dates. Income and other taxes, if any, are the responsibility of prize winners. No substitution, assignment, redemption for cash, or transfer of any prize permitted. Sponsors, at their sole discretion, may choose to substitute a prize of equal or greater value. Bootcamp must be completed on or before December 31, 2009. GRAND PRIZE: ONE (1)Grand Prize is the Culinary Boot Camp - Basic Training at the Culinary Institute of America in Hyde Park, NY for five (5) days and $1,000 for travel, lodging and miscellaneous expenses. Retail Value of $3095.00. Second Prize: ONE (1) Culinary Institute of America 50 Piece Masters Set Retail value is $1599.95 (USD$). Third Prize: ONE (1) 10 Piece Cookware Set. Retail Value is $499.95 (USD$). Prize elements subject to availability, certain restrictions and blackout dates. Income and other taxes, if any, are the responsibility of prize winners. No substitution, assignment, redemption for cash, or transfer of any prize permitted. Sponsors, at their sole discretion, may choose to substitute a prize of equal or greater value.
5. Claiming prizes/releases: Eligibility, age and claim by potential prize winner are subject to verification. Potential Winner will be notified by phone and/or E-mail. Sponsors are not responsible for fraudulent calls or E-mails made to entrants not by Sponsors. Potential prize winner must sign before a notary and return an Affidavit of Eligibility/Prize Acceptance/Liability and (where permissible) a Publicity and Copyright Permission Release Form within ten (10) business days of receipt. Non-compliance may result in disqualification and the prize will be awarded to an alternate Prize Winner via random drawing from among all remaining entries. If any prize, prize notification or attempted notification is returned as undeliverable, or potential winner does not respond within ten (10) business days, or return required paperwork within the aforementioned timeframe, prize will be forfeited and may be awarded to an alternate winner via random drawing from among all remaining entries.
6. Internet: If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, use of bots, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsors reserve the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. The Sponsors assume no responsibility for lost, late, misdirected, incorrect, garbled or incompletely received entries for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsors are not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any E-mail or entry to be received by the Sponsors due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of a winner based on an E-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the E-mail address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an E-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, education institution, etc.) that is responsible for assigning E-mail addresses for the domain associated with the submitted E-mail address.
7. General: By entering this Sweepstakes, entrants and Prize Winner: (1) agrees to be bound by these rules; (2) agree to release Sponsors and their parent companies, distributors, subsidiaries and affiliated, advertising, Sweepstakes and fulfillment and/or judging agencies from all liability, claims, action or proceedings related to the Sweepstakes, and from injuries or damages relating to acceptance and/or use of the prize; and (3) Prize Winner consents to the use by Sponsors of their name, voice, video, photographs, pictures and likeness for advertising and Sweepstakes purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law. Sponsors are not responsible for errors in the administration or fulfillment of this Sweepstakes, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this Sweepstakes based upon such error at its sole discretion without liability. Sponsors reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsors’ reasonable control impairs the integrity or proper functioning of the Sweepstakes as determined by Sponsors in their sole discretion. Sponsors reserve the right in their sole discretion to disqualify any individual they finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other Sweepstakes or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law. Each entry must be submitted only by the entrant and only at the authorized web site address. Entries submitted by any other individual or any entity originating at any other Internet web site or email address, including but not limited to commercial sweepstakes subscription notification or entering services sites, will be declared invalid and, as such, ruled ineligible for this Sweepstakes. Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
8. By providing information to enter the Sweepstakes, you acknowledge that Sponsors may also share your E-mail address with their affiliates and unrelated companies and send you information, samples or special offers they feel may be of interest to you about Sponsors’ products or services, or other complementary brands or carefully-selected companies. 10. Sweepstakes Winner: The Sweepstakes Prize Winner will be randomly selected from all eligible entries by the Sponsors. The decisions as to the administration and operation of the Sweepstakes and the selection of potential winners are final and binding in all matters related to the Sweepstakes.
11. ALL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION BY SPONSORS, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE SWEEPSTAKES SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY, AND THE POTENTIAL SWEEPSTAKES WINNER HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSORS WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.
12. Verification of Potential Winners: Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential Sweepstakes winner will be notified by email, telephone, or registered mail after the date of random drawing. The potential Sweepstakes winner (parent/ legal guardian if winner is a minor in his/her state of residence) will be required to sign and return to the Sponsors, within ten (10) days of the date notice is sent, an affidavit of eligibility and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable. If a potential winner of any prize cannot be contacted, or fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable) or cannot attend the Culinary Institute of America classes in Hyde Park, NY on the dates specified, potential winner forfeits prize. In the event that a potential winner of any prize is disqualified or forfeits for any reason, Sponsors will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
13. Sweepstakes prize: ONE (1) GRAND PRIZE: Approximate Retail Value ("ARV"): $3095.00 (USD$). ONE (1) Second Prize: ARV $1599.95 ONE Third Prizes ARV $499.95. Odds of winning the Sweepstakes prize depend on the number of eligible entries received during the Sweepstakes Period. No cash equivalent and all prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use.
14. Release: By receipt of any Sweepstakes, winner agrees to release and hold harmless Sponsors, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/Sweepstakes agencies and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.
15. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winners consent to Sponsors’ and its agents' use of winner's name, likeness, photograph, voice, video, opinions and/or hometown and state for Sweepstakes purposes in any media, worldwide, without further payment or consideration.
16. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsors, at their discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated prize will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes (one) by a random drawing among all legitimate, unawarded, eligible entries.
17. Sponsors will use Information collected from entrants only in a manner consistent with the Sponsors’ Privacy Policies as detailed on their websites privacy, other than noted above, related to the use of entrants’ email addresses.
18. Sweepstakes Results: For Sweepstakes results and/or a copy of these Official Rules, send a hand-printed, self-addressed, stamped #10 envelope to "MetroKitchen 10th Anniversary Sweepstakes Winners/Rules,” 4041A Kingston Court, Marietta, GA 30067. Requests for winner list must be received by January 10, 2009. VT residents may exclude return postage.
